These Terms govern your access to and use of the Marina BMP platform. By creating an account or using the service, you agree to these Terms. Please read them carefully.
1. Who we are
Marina BMP (“Marina BMP”, “we”, “us”, or “the service”) is a berth management software platform operated by Orgi Dautaj, based in Albania. You can contact us at marinaberthmanagerpro@gmail.com.
2. The service
Marina BMP provides web-based software for managing marina operations, including berth assignments, vessel records, customer management, reservations, invoicing and reporting. We provide the software “as a service” and continuously work to improve it. Specific features may change over time.
3. Accounts and eligibility
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must be at least 18 years old and authorised to enter into these Terms on behalf of yourself or your organisation.
- You must notify us promptly of any unauthorised use of your account.
4. Subscriptions, billing and payment
Marina BMP is offered on a monthly subscription (€10/month), as described on our Pricing page.
- Payments are processed by Paddle.com Market Limited, who act as the Merchant of Record and authorised reseller for all purchases. Your purchase is therefore also subject to Paddle’s buyer terms.
- Monthly subscriptions renew automatically each month until cancelled. You may cancel at any time, and your plan remains active until the end of the paid period.
- Applicable taxes (such as VAT) are calculated and collected by Paddle at checkout based on your location.
- Prices are stated in euros (EUR) and may change with reasonable advance notice; changes do not affect the current paid period.
5. Refunds
Paid plans are covered by a 14-day money-back guarantee. Full details, including how to request a refund, are set out in our Refund Policy.
6. Acceptable use
You agree not to:
- use the service for any unlawful purpose or in violation of any applicable law or regulation;
- attempt to gain unauthorised access to the service, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the service;
- reverse engineer, resell or redistribute the software except as expressly permitted;
- upload content that is unlawful, infringing, or harmful.
7. Your data and content
You retain ownership of all data you enter into Marina BMP (such as berth, vessel and customer records). You grant us a limited licence to process this data solely to provide the service. Our handling of personal data is described in our Privacy Policy.
8. Intellectual property
The Marina BMP software, design, branding and underlying technology are owned by us and protected by intellectual property laws. These Terms do not transfer any ownership of the software to you; they grant you a limited, non-exclusive, non-transferable right to use it while your plan is active.
9. Availability and changes
We aim to keep the service available and reliable, and Marina BMP is designed to work offline for core operations. However, we do not guarantee uninterrupted access and may modify, suspend or discontinue features with reasonable notice where practicable.
10. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the service will be error-free or meet every requirement.
11. Limitation of liability
To the maximum extent permitted by law, Marina BMP and its operator will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid for the service in the 12 months preceding the claim.
12. Termination
You may stop using the service and cancel your plan at any time. We may suspend or terminate your access if you materially breach these Terms. On termination you may export your data in accordance with our data-portability features before access ends.
13. Governing law
These Terms are governed by the laws of Albania, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide you with additional rights.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new “last updated” date and, where changes are material, take reasonable steps to notify you.
